Hello! I'm Gin, a 23 year old nonbinary artist from Texas.
I've been drawing for a little over 10 years. I'm skilled in character design, digital and traditional illustration, and I love to draw monsters, sci-fi, fantasy, and cartoons!
Commission Terms of Service
Section I. Image Copyright
I, The Artist, retain full and exclusive rights to the original artwork which includes but is not limited to distribution, reproduction, and use of the Commission for Artist promotion (e.g., Social Media, Personal Space, Public Space, etc.).
By commissioning the Artist, the Client is purchasing the Artist's labor only.
All commissioned artwork is for non-commercial use, unless agreed upon in the Commission Agreement prior to Start of Work. Artwork commissioned for commercial use will have an additional fee that is agreed upon in the Commission Agreement.
Conditions for reposting commissioned artwork:
The Client may display the Commission in Social Media as long as the Artist's name (Smolzart) is prominently displayed along with a link.
The original watermark/signature must remain intact and unaltered.
Prohibited Actions
The Client may not distribute, reproduce, or otherwise profit from the Commission beyond the sale of the original Commission unless as agreed upon in the Commission Agreement prior to Start of Work.
This includes but is not limited to: Crypto-currency, NFTs (Non-fungible tokens), Etc.
The Client may not edit, alter, or copy the Commission without the Artist’s expressed written permission or as agreed upon in the Commission Agreement prior to Start of Work.
Under no circumstances may the Client submit a Commission to any kind of contest.
Section II. Payment Information
Payment is accepted in USD only.
All USD payments will be taken via Paypal invoice only.
Full or Partial Payment must be received prior to the start of the commission.
Non-payment will result in the commission being cancelled.
Payment must be received within 48 hours of receiving the invoice and the Commission Agreement has been signed. Failure to do so will result in the Commission being canceled.
The client holds no rights to the commission until after full payment is received.
Refund Policy
If a Commission is cancelled (by The Artist or Client) before work has begun, then the Client will receive a full refund.
If the Client cancels the Commission once progress has started, the amount refunded will be on a case-by-case basis and up to the Artist’s discretion.
No refunds will be given for completed Commissions.
The Artist reserves the right to refuse a Commission at any time without reason.
Section III. Contact and Communication
Communication regarding Commissions
Are conducted via email OR discord/twitter/etc. If the Client has requested an update to their Commission, prompt and clear communication is necessary.
If the Artist has not received any communication from the Client within two weeks, then the Commission will be bumped to the bottom of the queue and stay until communication is established again. If communication is not picked up within 30 days of the initial order date of the Commission, the Commission slot is forfeited and no refunds will be given.
The Artist reserves the right to stop work on a Commission or cancel a Commission request due to poor communication, rude/inappropriate behavior, or a breach of these Terms of Service.
If the Commission is designated as confidential in the Commission Agreement, the Artist will temporarily delay public display of the image at the request of the Client and as defined in the Commission Agreement until such time as specified in the Commission Agreement where public display is permitted. A Client may not request the Artist to complete a Commission without defining the time span in the Commission Agreement to eventually allow the artist to publicly display the image.
Deadlines
If the commission is time-sensitive, a rush fee may be applied, to be defined and agreed upon in the Commission Agreement prior to start of work.
Digital Format and Printing
Digital art Commissions will be provided to the Client via email or an online download location in .png or .jpeg format; this does not include the Commission native files (e.g., .psd, etc.) unless agreed upon in the Commission Agreement, or thereafter, the Client obtains written permission from the Artist. The Artist is not responsible for the cost of shipping a Commission (traditional art, or any digital media device or print of a digital art Commission); the Client is responsible for all shipment Costs.
The Artist is not responsible for printing (creating a hard copy of) a digital art Commission or reproducing prints of a traditional art Commission for the Client unless agreed upon in the Commission Agreement. The Client may use the digital (.png/.jpeg) for local printing so long as it does not breach (terms) and the Client obtains written permission from the Artist prior to printing.
Visual Reference Guidelines
Clients must provide an image reference but short, detailed and concise descriptions are accepted. Please do not make long paragraph based descriptions as they can be confusing.
If the Client has a specific pose in mind, they must provide a reference or a simple sketch.
The Client must specify the desired display size of the Commission, regardless of whether the Commission is completed digitally or traditionally.
Section IV. Will/Won't Draw
The terms listed below are what the Artist is willing or not willing to draw. The Client may ask the Artist any questions about content not listed below.

NSFW or otherwise Suggestive Art of Minors (IRL or Fictional).
* This will be on a case by case basis determined by the Artist. Please ask if you have questions in regards to these.
The Client must be over the age of 18 to commission adult content as under the United States Law. Failure to adhere to these terms will result in the Artist blacklisting and blocking on all social media and means of contact.
Section IV. Workflow Process
The date of completion is to be defined and agreed upon prior to the Start of Work.
Works in Progress (WIPS)
The Artist will send WIPS at each stage of the Commission at their discretion using the Client’s preferred contact. Progress will be paused until the sketch is confirmed by the Client.
Revisions and Edits
If the Commission type includes a sketch approval stage, any major changes or revisions must be made at this stage including but not limited to poses, clothing, or anything regarding redrawing parts of the image.
After the sketch has been approved, no major edits or changes will be made. If the Client requests additional changes after the approved sketch, a fee may be added to the final balance at the discretion of the Artist. This will be on a case by case basis.
If an error was made on the Artist’s part on the Commission in regards to character design, accessories or any other visual elements that was specified in the Commission request and visual references, the edits will be made at no additional cost.
